Certain assets such as life insurance policies pass outside of probate. The separate filing must be made with each life insurance company and the proceeds are paid to the beneficiaries on record with the life insurance company as designated as part of the policy.
Other non-probate assets include IRAs and 401K amounts which also pass by designation of beneficiaries.
Bank account and brokerage accounts may also be passed as non-probate assets by transfer on death ("TOD") provisions.
